The war on the native

The nation state is a very new invention. It originated in Europe in war and conquest, as armies conquered some tribes and massacred others. It has expanded and grown and continues to do so to this day. The state was forged in war to subdue others. This basic form remains constant, though the scope of the state has grown, along with expectations about what it can and should do.

The nation was shaped by other processes. Benedict Anderson famously explains that print capitalism was the strongest driver of the forming of the nation and nationalism, as it spread a common language within the borders of the state that did not exist prior to conquest. Since then, the idea of a common culture has taken hold and the nation grows more certain of itself. The advance of media technology in the twentieth century continued this trend. Anderson called nations “imagined communities”, because they were huge groups of people who would never meet with a communitarian identity.

From a different angle, Ernest Gellner writes,

nationalism is, essentially, the general imposition of a high culture on society, where previously low cultures had taken up the lives of the majority, and in some cases of the totality, of the population. It means that generalised diffusion of a school-mediated, academy-supervised idiom, codified for the requirements of reasonably precise bureaucratic and technological communication. It is the establishment of an anonymous, impersonal society, with mutually substitutable atomised individuals, held together above all by a shared culture of this kind, in place of a previous complex structure of local groups, sustained by folk cultures reproduced locally and idiosyncratically by the micro-groups themselves.

In 1648, the Treaty of Westphalia, which ended the 30-Years War (yes, the history of the state is of chaos; it is hard to think one’s idea of “anarchy” could be as bad), effectively baptized the nation state. State borders grew stronger. It was assumed among states that sovereignty, meaning the mutual acceptance of the other’s monopoly on crime within its boundaries, was to be respected. Of course, the urge to use an army at one’s disposal is too great, and the fighting continued until the number of states in Europe shrank and the power of each one to kill grew.

Around 1789, the idea that the state should represent the people, preserve liberty, equality, fraternity, or other revolutionary slogans, caught on. National education systems were erected, inculcating everyone in the logic of the state and the primordiality of the nation. The nation state became timeless, obvious and unassailable. The nation state expanded beyond its borders, as European empires built big ships and conquered the globe. To reach their goals, they killed whomever they had to kill, on any continent they felt like taking.

Ultimately, what the empires left their conquered peoples with was the nation state. The nation state has broken down old social structures and erected new ones. It groups millions of disparate people and assumes they can be represented by a ruling class. It assumes rule by a ruling class is preferable to whatever it has destroyed. It has institutionalised theft and slavery. It has militarised the criminals and disarmed their victims. And even though it legally covers every inch of land in the world, its power over the people within those lines continues to expand. One result of modern state expansion is a war on the native.

Indigenous people all around the world have been persecuted since the inception of the state. They have been forcibly moved so they could be taxed or so the powerful could gain access to land and other resources. They have been killed when they have resisted. Many groups we have never heard of have been wiped out over the years. Others have been decimated and pacified and pushed onto “reservations”. In recent years, much of this wanton violence has been at the request of large extracting corporations. Such corporations, oil and gas concerns, for example, function almost as the right arm of the modern state. The state is a vehicle for accumulating power; the corporation is the most powerful modern tool for accumulating wealth. Heads of state and corporations work together to extract wealth and repress those who challenge them.

Under the nation-state system, the real owner of all land (and thus resources on that land) within the borders of the state is the state. Some states afford a measure of land or property ownership to those not connected to the state, but not many. Even Canada has seen a number of oil spills on supposedly-private land in recent months. Perhaps the people living on the poisoned land will be compensated. But the fact that someone else could ruin their land and they will need to petition the state for restitution is evidence they did not own the land to begin with. Moreover, secession is an option for free members of a federation, but not for citizens of the modern nation state.

A number of indigenous groups in the Amazon, such as the Kayapó, above, have protested the state’s plan for the Belo Monte Dam. This dam promises to flood a large area of land, dry up other land around the river, devastate parts of the rainforest and hurt fish stocks. Tens of thousands of people in the Xingu River basin are in danger. The locals have protested since the initial proposal of the dam in the 1980s and their demands have been ignored. They are now being attacked and moved. The dam will be built. The people with deep, spiritual ties to this land never had any recourse because those in power did not recognise their claim to the land. The state treats those it can use as tools and those it cannot as waste.

Similarly, in Indonesia, conflict is growing as large corporations have been tearing down forests and erecting palm oil plantations. Henry Saragih, founder of the Indonesian Peasant Union says

The presence of palm oil plantations has spawned a new poverty and is triggering a crisis of landlessness and hunger. Human rights violations keep occurring around natural resources in the country and intimidation, forced evictions and torture are common. There are thousands of cases that have not surfaced. Many remain hidden, especially by local authorities.

Naturally, no one is ever consulted or compensated when their habitat is stolen from them. Local security forces protect foreign corporations. The beneficiaries of globalisation and economic growth do not need to pay its prices.

Unsurprisingly, some people have resisted with violence. Under modern state parlance, they are called terrorists and insurgents. People who once farmed land in much of India until they were kicked off have formed a loose movement known as the Naxalites, led by Maoist intellectuals. Companies such as South Korea’s Posco Steel have appropriated other people’s land for their own purposes, with the help of local police. A peaceful anti-Posco movement has arisen, but protests have gone nowhere. Politicians are under pressure from the companies they have already promised to let build and the villagers who will lose their land; they make more money off the corporations so they just repress the villagers. The Naxalites oppose the advance of the state, and have killed civilians and security forces alike.

India’s prime minister, Manmohan Singh, has called the Naxalites “left-wing extremism” and “the single biggest internal-security challenge ever faced by our country”. Bolstered by the advent of 9/11 and the War on Terror, the Indian government has arrested and killed thousands of Naxalites and their supporters in order to maintain its monopoly on crime. On the violence committed by both sides, Arundhati Roy opines

I think you’ve got to look at every death as a terrible tragedy. In a system, in a war that’s been pushed on the people and that unfortunately is becoming a war of the rich against the poor, in which rich put forward the poorest of the poor to fight the poor, [security forces] are terrible victims but they are not just victims of the Maoists. They are victims of a system of structural violence that is taking place.

In some places the Naxalites enjoy popular support. As with other violent, persecuted groups, however, some Naxalites have used violence against unarmed locals, and have been less popular. As with the War on Drugs and countless other cases of aggression, violence begets violence.

At the same time, the Indian government has pursued a hearts-and-minds campaign of offering “development”, such as roads and schools. The simultaneous application of force and the promise of economic incentives has been praised by the Economist and others of similar persuasion. Vandana Shiva, on the other hand, believes “If the government continues its land wars in the heart of India’s bread basket, there will be no chance for peace.” This strategy is bound to fail as it does not address the roots of the problem. Indeed, it has failed. The people are not interested in being absorbed by the nation state. Explains BD Sharma, “[f]or them, development means exploitation.” This should not be surprising. The nation state views incorporation into its ambit a step up, from barbarism to civilisation. The discourse assumes a model of progress from life outside the state, thought of as unhealthy, backward and hostile to life as part of the state, meaning education, health and higher culture. It defends displacing people from their ancestral homes with its offer of schools, hospitals and integration into the wider economy. But the state always achieves its goals with violence.

James C. Scott’s The Art of Not Being Governed explains the logic of the state and escape from it through the case of the highland people of Southeast Asia. The evidence is strong that many or all of the people living in the mountainous region recently dubbed Zomia are there because some time over the past thousand years or so they have chosen the life of barbarity over forcible incorporation into the state. One of a number of groups Scott considers is the Karen.

Many of those we now call the Karen consciously fled the predatory state to escape appropriation of their land and agriculture, forced relocation or slave labour. The Burmese military government has attempted to subdue and incorporate the Karen. They fought back for many years, but eventually, technology caught up and the last major Karen base was destroyed in 1995. The people continue to hold out, however, in small groups. The Burmese military continues to wage its campaign against them. It burns down fields and lays mines there. Soldiers fighting Karen guerrillas, conscripted and paid a pittance, take whatever they want from villages on the front lines, and end up terrorising their inhabitants. Like other persecuted groups of Zomia, the Karen have adopted flexible agricultural techniques, mobility, shifting ethnic identities and social structures that split easily over political, social or religious issues. But the state advances and the Karen get easier to destroy. Scott believes it is only a matter of time before the people of Zomia become tax-paying subjects of the state once again.

Nigeria has also seen terrorism as natives of the Niger Delta have defended themselves against oil companies. The campaign to defeat the locals long enough to extract oil and dump waste has involved police and military, who have done their best to turn ethnic groups against each other. As a result of two decades of conflict, the entire region has militarised. Royal Dutch Shell was implicated in the murder of activist Ken Saro-Wiwa. As with other corporate malfeasance punished by a monopolist court system, it cost a trifle and enabled the firm to return to business as usual. Shell is not the only company working the area, as Chevron and Nigeria’s national petroleum company are involved as well. The struggle for freedom from the state in the Niger Delta is not over.

Is there hope in democracy? Under Rafael Correa, the government of Ecuador sued Chevron for billions for the destruction of the environment of thousands of people. Of course, a few billion is a drop in the bucket for such a firm, but at least a symbolic victory is possible. Says Andrew Miller of Amazon Watch, Chevron

left hundreds of toxic waste pits. It dumped billions of gallons of toxic waste. And really, the whole time that this trial has been going on over the course of 18 years, the communities continue to live with that legacy, and they continue to suffer the impacts, the health impacts, the cultural impacts, the environmental impacts of that destruction. And so, this is an important day for the communities. It’s just one step; it’s not a victory. But it is very crucial for them. It’s also an important day for the broader struggle for corporate accountability around the world, for broader struggles for environmental justice and human rights.

Perhaps. Will it set a precedent? An example for other indigenous people? The damage has been done. The environment has been wrecked. And it might just leave the same people open to abuse from Petroecuador, which has caused its share of oil spills. And other Andean people are even less fortunate. (See here and here.) The people have been forced to work through state structures, further integrating them into the nation state, and have been lucky enough finally to have someone in the state who will fight for them. None of these things will last if their sovereignty, over their land and their labour, is not recognised.

It is important that we learn the history of both states and nations. On the history of the state, I recommend Franz Oppenheimer’s The State, James C. Scott’s The Art of Not Being Governed, Hans-Hermann Hoppe’s Democracy: the God that Failed, Martin van Creveld’s The Rise and Decline of the State and Bruce D. Porter’s War and the Rise of the State. The Egyptian army is no friend of the people

Today, on the first day of Ramadan, a day of celebration and peace if ever there was one, the army cleared Tahrir Square of the tent city that had controlled the Square since July 8 and arrested some of its occupants. This overt use of force against the revolution should persuade the people that the army is not their friend.

Hosni Mubarak stepped down on February 11 under somewhat mysterious circumstances. After claiming he would remain in power the night before, Mubarak quickly disappeared to the Egyptian resort town of Sharm el-Sheikh. The Supreme Council of Egyptian Armed Forces stepped in. It is possible that the army persuaded him to leave, and equally possible that the power elites had planned this move to make the new government popular.

The army has paid lip service to the demands of the protesters, but has done little to satisfy them.

-First, the families of the martyrs of the revolution, many of them camped out in Tahrir, have seen no justice. They are demanding restitution, and they are getting the strongarm.

-Second, as many as twenty thousand of the peaceful revolutionaries jailed since the beginning of the revolution received trials lasting a few minutes and sentences lasting several years. The jailed youth, such as blogger Maikel Nabil Sanad, a 26 year-old blogger sentenced to three years in prison for criticising the military, usually have had no access to proper legal counsel. The people have been calling desperately for their release, and the military has not been forthcoming. “Egypt’s military leadership has not explained why young protesters are being tried before unfair military courts while former Mubarak officials are being tried for corruption and killing protesters before regular criminal courts,” said Joe Stork of Human Rights Watch. “The generals’ reliance on military trials threatens the rule of law by creating a parallel system that undermines Egypt’s judiciary.”

-Third, instead of trying the peaceful and innocent, Egyptians expected trials of the police, the thugs and the ancien regime. The police were the repressive hand of the government while Mubarak was in power, and have lost most of their power since the revolution. Police and interior ministry snipers are responsible for the deaths of many of the protesters killed in the early days of the revolution. The youth fought back and repelled the police, but the government had other tricks up its long sleeve. During the 18-day demonstrations that brought down Mubarak, the government released a number of thugs from prison to attack the people. They burst into Tahrir Square on the Day of the Camels, riding camels and horses into the Square and wielding swords and sticks. After the police fled, the thugs went to every neighbourhood to terrorise the people into begging the police to come back. Instead, the people banded together to protect their neighbourhoods. The corrupt ministers of the old government, too, are perceived to have been protected since the fall of Mubarak. Demonstrators have demanded a complete overhaul of the interior ministry, and have been given a shuffle. The people want justice, which to them means the trial and sentencing of the police, the thugs and the thieves, and they want their money back. Thus far, they have not found it.

-Fourth, the ever-present Palestinian question was supposedly answered when Egypt’s government announced in May that it would open the Rafah crossing to the Gaza Strip, giving at least some freedom and humanitarian aid to the Palestinians trapped in the prison camp of Gaza. Both Israel and Egypt have imposed a strict blockade of Gaza since 2007, when Hamas took it over. Restrictions on movement in and out of Gaza have eased slightly, but progress has been disappointing at best. All the real demands of the protesters have gone unheeded.

The army will do its best to ensure that the privileged position beyond the control of civilian government it has always maintained remains protected. For the past few months, volunteers have stood at every entrance to Tahrir Square, checking passports for anyone who might be a known thug. They have entered the Square once or twice nonetheless, with violent results. Today, the army seems to have ushered them in with the soldiers. Egyptian newspaper Al-Masry Al-Youm stated that “[m]ilitary police, Central Security Forces and civilian supporters” destroyed the sit-in that has characterised the heart of Cairo for the past few weeks. Perhaps the paper does not want to editorialise, but it is probable that the “civilian supporters” are the same thugs that have been trying to wreck the revolution since the Day of Camels.

At last count, the military and its supreme leader, Gen. Mohamed Tantawi, enjoy wide support among Egyptians. This move may sour the belief that the army is a friend of the revolution. Either way, Egyptians have no reason to continue to trust the government or end the demonstrations of the ongoing Egyptian Revolution.

The PA, the UN, Egypt and the flotilla: no help for the Palestinians

Two states?

In September of 2011, the Palestinian Authority will approach the United Nations for a resolution recognising Palestine as a new member state. Against the backdrop of what are still hopefully being called the Arab revolutions, much of the world believes that UN recognition will force Israel to follow suit and recognise, and thus leave in peace, a Palestinian state in the West Bank and Gaza.

The government of Israel often warns that a sovereign Palestine would mean Hamas’ taking power, probably violently, and then using a new state as a launching pad for the destruction of Israel. However, one must doubt that Hamas is so irrational. Its leaders are well aware that they would be blown to dust if they initiated a war with Israel. Their being religious does not change that. Religious governments are not crazy, and are as likely as non-religious ones to make war. Iran, for all the Israeli and US rhetoric attacking it, seems to have no intention of starting wars. Why would a poorly-armed, dishevelled group like Hamas?

However, with a state, a legitimate government would set up legitimate defense forces against Israeli aggression. It would enable Palestine’s acceptance as a member of the UN. It would also mean the possibility of self-reliance for its citizens, instead of depending on foreign aid under the constant threat of land expropriation and housing demolitions. Finally, it could end the Palestinian refugee issue (though not satisfactorily, as many insist on the “right of return” of all refugees to their previous homes and parents’ and grandparents’ homes, which could be anywhere in Israel or the Palestinian territories). Of course, given Israeli government interests in the status quo in East Jerusalem, the West Bank and Gaza, and its continual proving its ruthlessness in pursuing those interests, all these hopes are mere hopes. After all, asked one West Bank resident, “who cares if we get recognised as a state if the Israelis can still block the roads?”

If Palestinians want a state, international law states that certain conditions must be met. First, it must have a stable population. Check. Second, it must have a government. The Palestinian Authority is not great, but it has the necessary institutions of a government. Check. Third, it must have a defined territory. This issue is contentious, to say the least. It is hard to know exactly where Israel begins and Palestine ends; but the hope is that a Palestinian state would be built on the pre-1967 lines: the West Bank, Gaza and East Jerusalem. More recent negotiations (not to mention the settlements) have reduced the size of the West Bank that could belong to Palestine but have partly compensated for the loss of territory with the idea of land swaps between the two states. The solutions are on the table, though the current Israeli government continues to require conditions that make reaching those solutions all but impossible. Fourth, it must have the capacity to enter into relations with other states. That requires recognition by other states. Most of the world’s states now recognise Palestine as sovereign, with the exception of the most powerful ones. But some governments do not recognise Israel as a state either, and some of its territory is considered illegal (the Golan Heights and East Jerusalem were annexed and settled—an unequivocal violation of international law) and yet it is obviously sovereign. But getting and holding a state will not be easy for anyone.

First, the Security Council needs to recommend statehood to the General Assembly, which might not happen. The US government, which can veto any Security Council resolution, has always vetoed resolutions that are not in the Israeli right wing’s self interest, and has done so recently. In doing so, it goes against the international consensus; but the powerful are not constrained by others’ opinions. Despite its posturing for decades, the US government has done little to promote peace and allow the recognition of a Palestinian state. It is possible that the PA can use General Assembly Resolution 377, which can be invoked to bypass the Security Council when it fails to act to maintain international peace and security (its main function), though it may not be valid for the purpose of recognising a new member state. Second, Israel’s diplomats are flying around the world to drum up support for the Netanyahu government’s Bantustan vision for Palestine. The US, of course, supports Israel in this endeavour, as does Germany.

Third, if somehow Palestine is recognised, the US government will not be its friend. The US senate voted unanimously last week that statehood should (a non-binding resolution) be obtained through negotiations and not unilateral declaration. In fact, not only will the US not negotiate with Hamas, whose participation in talks is just as legitimate as that of any other party, the PA opted to approach the UN because there was no peace process to speak of. The resolution consists entirely of conditions directed at the Palestinians (eg. “any Palestinian unity government must publicly and formally forswear
terrorism, accept Israel’s right to exist, and reaffirm previous agreements made with the Government of Israel”, including, presumably the humiliating Oslo Accords), as the US government never puts any pressure on Israel. Susan Rice, White House ambassador to the UN, has also threatened to suspend all aid to the PA if it gains statehood. Though much of that aid goes into the pockets of the corrupt PA, some of it is nonetheless recycled back into the economy. If a sovereign state will lead to rapid growth in the private sector, Palestine has a chance for self-sufficiency. If not, the Palestinians might be worse off than before. Do the Palestinians have any powerful friends?

Egypt

Egypt’s revolution held promise not only for Egyptians, but for Palestinians as well. In 2007, at Israel’s behest, Egypt blocked all access to the crossing at the town of Rafah that straddles the Sinai and the Gaza Strip. In post-(or mid-) revolutionary Egypt, under pressure from the people, the transitional government promised it would open the crossing. A legitimate Israeli fear was that the crossing would become the transfer point for masses of weapons, but it was to be screened for such things like a normal national border. But since the Egyptian junta’s announcement, little has changed. Palestinians applying to leave Gaza—some 20,000—are being told to come back in September. Aside from a few hundred travelers (on a good day) and a mere two truckloads of exports a day, mostly only journalists and ambulances can leave the Strip. One official said it might take months for the Egyptian government to send enough personnel to man the border. Perhaps they are walking there. It has also been reported that, despite pledges of independence from the US and Israeli governments, these two have been reportedly pressuring Egypt not to ease restrictions. Disappointing, to say the least.

The flotilla

The Freedom Flotilla of over a dozen ships is headed for Gaza. The purpose of the flotilla is partly to bring humanitarian aid to Gaza but mainly to bring international attention to the terrible plight faced by the Strip’s inhabitants. It is carrying three thousand tons of aid and its members are from dozens of countries. It is easy to understand why so many people feel strongly about Gaza. Gaza is the most crowded area on earth, with 1.5m people crammed into 360km2. Four out of five Gazans rely on humanitarian aid; 40% of Gazans are unemployed; 80% live in poverty.

Given the impossibility of legitimate trade with the outside world, Gazans long ago resorted to transporting goods by tunnels, which are sometimes bombed by Israel (see here and here for two articles on the latest such attack). Middle East Online says that “[p]rior to Israel’s ‘easing’ of the blockade in 2010 [following the first flotilla debacle], an estimated 80 percent of goods in Gaza’s stores were smuggled through the border with Egypt. Now most consumer goods in the markets and corner shops come from Israel.” Gazans are as enterprising and rugged as anyone else. They do not really need humanitarian aid; they need the ability to trade. According to deputy head of the ICRC in Gaza Mathilde De Riedmatten (and everyone else who has been there), the Strip, essentially a large prison camp, continues to experience crises in health care, water and sanitation. Agriculture has suffered, not only because fertilizers are on the long list of items banned under the blockade, but also because the IDF periodically levels the land and uproots trees. Construction materials cannot enter the Strip, and since Operation Cast Lead in 2008-9, they have been needed to repair all manner of buildings. God knows what would happen if Israel repeated its indiscriminate slaughter of Gazans from two years ago, with Gazans still unable to leave. But despite implausible claims that there is no humanitarian crisis in Gaza, the powerful do not want the flotilla to continue.

Professor Stephen Zunes said in a recent piece on the flotilla that “nothing frightens a militaristic state more than the power of nonviolent action.” Israeli newspapers have printed the foreboding words of many Israeli officials that Hamas is involved in the organisation of the flotilla, that its intent is to smuggle arms, and that its members plan to attack Israeli soldiers, while others have ridiculed such claims. In his inimitably clever way, Christopher Hitchens attempts to take apart the members of the flotilla. He assumes that the humanitarian convoys will bolster Hamas, rather than help the people; and he questions the motives of the organisers by implying they are associated with the regime of Bashar al Assad of Syria and Hezbollah, which seems, I think any reasonable reader can agree, a stretch. Then he mentions al Qaeda, having learned from George Bush that saying two words in the same speech (“Saddam” and “al Qaeda”) forces listeners to associate the two mentally, when of course they have nothing to do with each other. Despite their use of words such as “proof”, there is little reason to take anything these people say seriously.

The only argument they have worth considering is that any feeding of the people of Gaza bolsters the Hamas government. However, that is only true if the blockade of Gaza had any hope of turning the people against Hamas, and so far it has not worked. How could it? History suggests that people punished collectively for supporting a certain group do not turn on the group but on their punishers. It is obvious that the true oppressors are the ones turning the screws on Gaza: Israel, and to a lesser extent the US and Egypt. The stated goal of the siege of Gaza has not and will not work. The inhumanity of punishing 1.5m people for 44.45% of voters’ electing a terrorist group when their alternative was a corrupt, unresponsive, collaborator party also escapes those who insist on maintaining the blockade.

All manner of coercion is taking place to prevent the flotilla from reaching Gaza. The Greek government, in a move that presumably will not make it any more endearing to its people, banned all ships in the freedom flotilla from leaving its ports. When a Canadian ship left Crete, Greek authorities intercepted it and took all 50 people on board into custody. Israel’s government threatened to jail any journalists found covering the flotilla for up to ten years. It dropped the ban not long after, though having changed their minds so quickly, one wonders if they might change them back. There is evidence that Israelis had sabotaged some of the flotilla ships.

However, there is no evidence any of the ships that are attempting to bring humanitarian aid to Gaza have been found to contain weapons or materials that could be used for military purposes. No evidence was found for the claim that the flotilla organisers have links to Hamas or other terrorists. In fact, flotilla organisers have likely done everything they can to assure there is no legitimate cause for Israel to attack any of its members, as it did last year when nine activists died in a confused fracas. Their non-violent resistance seems in line with the thinking that produced the phrase “If you want to beat Mike Tyson, you don’t invite him into the ring, you invite him to the chessboard.”

Though there is no real evidence the flotilla poses any threat to Israel, the US government has stated it is not willing to protect the US citizens on board against an Israeli attack, and that such an attack is well within Israel’s right. The ships will not be passing into Israeli waters but international waters, followed by the coast of Gaza, which is only blockaded by Israel. It seems unlikely any state has the right to attack unarmed people in international waters; either way, it leaves the Palestinians and those who want to help them find justice without a friend or saviour.

How about one state?

Does all this mean the only hope for a Palestinian state for the PA to take matters into its own hands? Much has been made of the Fatah-Hamas reconciliation agreement, with its possibility of integrating Hamas into a new PA. But not only will such a government be rejected by Israel and the US, Palestinians do not seem to hold out much hope for it either. The PA, set up by the Oslo Accords in the 1990s, is seen by many in the West Bank as collaborators: the police of the occupation. The two parties presumably feel the need to work together to obtain statehood, but where would they go from there?

Another question that others have asked is, is a Palestinian state the best way to achieve freedom? Again, if Israel is still in the neighbourhood, still wary to the point of paranoia about any Arab provocation, still hungry for land based on ancient myths of an Eretz (Greater) Israel, an independent Palestine will mean little. One often hears the phrase “facts on the ground”, usually used to imply that settlements have changed Israel’s requirements since 1967, but which obfuscate the issue by making the settlements of the West Bank and East Jerusalem seem irreversible, when the settlements of the Sinai and Gaza were not. In spite of the mess on the ground, it has been said since the beginning of the Arab Spring that Israel will have to make peace sooner rather than later. I do not share this optimism; but since many of the people who do are people who know the issue better than I, let us consider an audacious, less realistic but vastly improved possibility: the one-state solution.

Ali Abunimah, founder of the Electronic Intifada, writes in his book One Country: a Bold Proposal to End the Israeli-Palestinian Impasse, “There is no credible ‘peace process’ to provide hope that the misery on the ground is merely a transitionary phase on the way to deliverance, and the one big idea that is supposed to save us—the Palestinian state—lies in tatters.” His thesis is that, if the inhabitants of the Holy Land can just learn to share, they would all be far better off. It is hard to escape his logic. Jews and Palestinians boast roughly equal numbers in Israel and the territories (6m each). They both claim ownership of the land on which they live. The fact that the West Bank and Jerusalem are so important to both Palestinians and Jews alike provides legitimacy to the claim that they should be shared. One state could mean the true right of return that gives all Palestinian refugees a place to live outside the squalid camps so many still inhabit. The two-state solution may in fact be the movement of the old guard. Fatah and Hamas may become (even more) irrelevant as the one-state cause picks up steam among young people in the Palestinian territories.

Israelis would need to abandon their unswerving claims to a purebred Jewish state in all the land of Israel/Palestine, which at the moment seems more distant than ever. Hamas would need to permanently abandon its rhetoric and violence. But if the flotilla achieves its PR goal, if non-violent Palestinian resistance continues to succeed, if the two-state bid fails and if international pressure on Israel increases, one state for Jews and Arabs might be the answer to the question of peace that everyone claims to want.

A glance at Egyptian political attitudes: the mood is high

Today, on the three-month anniversary of the start of the Egyptian revolution, a new Pew Global Attitudes Poll of Egypt has come out. Now that freedom of speech is a reality, everyone is talking politics, and they are bursting with opinions.

The past:
77% of those polled said Mubarak’s resignation was a good thing. (Judging by the party blazing in and around Tahrir Square tonight, people are still pretty happy with the outcome of the revolution. I have met few young people here who had no involvement in the revolution.)

When asked what has concerned them most in Egypt in recent years, respondents answered corruption, lack of democracy, and then the economy. The first two of those are likely to change thanks to the revolution, as from now on Egyptian governments will need to listen to the people. (An end to corruption could help the economy, though a democratic government could create any kind of misguided economic policy.)

The present:
Most have very or somewhat favourable opinions of the Muslim Brotherhood and the April 6 Youth Movement. The Muslim Brotherhood has been the largest opposition group in Egypt since 2005, when its members ran as independents (because the party was illegal) and won 20% of the vote. The Brotherhood came a little late to the party, officially joining the revolution after its inception and declaring that the revolution was not an Islamic but an Egyptian revolution. Now, having maintained its organisation, it remains one of the most powerful political parties in Egypt. The April 6 Movement started as a Facebook group in 2008. They demanded democracy and an end to corruption. April 6 was one of the groups encouraging young people to come out into the streets on January 25. April 6 was also one of the reasons some observers said that, though the outbreak of the revolution was a black swan, some kind of uprising had been a long time coming.

The poll found Mohamed Tantawi, head of the Egyptian Armed Forces (and thus de facto head of state) and Amr Moussa, secretary general of the Arab League, the most popular leaders, though Tantawi will probably not contest the fall presidential election and Moussa probably will. The military is still seen in a positive light, with 88% approval. The people are more cautious about the religious leaders, though they approve with similar numbers. The police, widely viewed as agents of Mubarak’s oppressive regime, are seen by 61% of respondents as unfavourable. In the kind of irony typical of public opinion, Mohamed El Baradei, the former director of the International Atomic Energy Agency, winner of the Nobel Peace Prize, and the man who stood up to the US on Iraq and Iran, came fourth in the polls, after Tantawi, Moussa and Ayman Nour. He is seen as something of a sop to US warmongers, when in fact he defied them. Amr Moussa, meanwhile, seems to have lost no popularity despite his affiliation with the Mubarak regime.

Egyptian opinions of the US and Barack are low (20% and 35% favourable respectively) but have not changed much since last year. 52% disapprove of Barack’s approach to the other Arab revolutions. Now that the people’s views need to be considered more strongly by Egyptian politicians, these low ratings have become more important, and will affect Egypt’s future responses to US foreign policy.

More significant might be Egyptians’ attitudes toward Israel. By a margin of 54% to 36%, Egyptians believe their country should annul the three-decade-old peace treaty between the two countries. The end of a peace treaty does not mean the start of a war. Canceling the treaty would be a kind of rebuke, an insult, or a demarche, saying “we are not happy with you”. It is one way to put pressure on another state. Knowing Israel’s habit of not caring what the rest of the world thinks, this poll result, and even the cancellation of the treaty, is not likely to change much. I suspect that there will be meaningful pressure on the next Egyptian government to end Egypt’s role in the blockade of Gaza; however, for strategic reasons, I doubt it will cancel the peace treaty or end the blockade.

The future:
65% said they were satisfied with the way things were going in the country, and 57% said they were optimistic about the future. I think it is safe to say that the 77% who are happy Mubarak is gone are happy with the outcome of the revolution, implying that they believe Egypt is better off now. That too is a kind of optimism.

41% believe a free and fair election is very likely, and 43% say it is somewhat likely. Again, the mood is very or cautiously optimistic. And so it should be. Egyptians, like Tunisians, accomplished a great feat in a matter of weeks, and have become a beacon to the rest of the world’s oppressed peoples.

Taking sides in a cyberinsurgency

As a student of war, I am fascinated by the prospect of an internet-based conflict. It is being called a cyberwar, though it may more accurately be called a cyberinsurgency: Contrary to predictions of a China-US or other interstate cyberconflict, this first (with the exception, as far as I know, of the 2007 attacks on Estonia), major, online, political conflict is between a government and a loose, decentralised group of non-governmental actors.

I do not particularly like the idea of taking sides in conflict. In my estimation, most belligerents in war are guilty of enough that they are all contemptible. But sometimes, based on one’s philosophy, one side has clear moral authority over another. To those attacking Wikileaks and the act of whistleblowing, let me make clear the position you are taking. You are in favour of covering up and hiding from the public

-the repeated urging of the despotic (and with relation to the US government, influential) House of Saud and other Middle Eastern governments to start a war between the US and Iran;

-the US’s ally Saudi Arabia’s funding of violent extremist groups al Qaeda, the Taliban and Lashkar-e-Taiba;

-the extent of the corruption of the Afghan government, which US, Canadian and other foreign taxpayers are funding;

-an accurate picture of the disastrous war in Afghanistan, including the extent of civilian casualties;

-and perhaps most disturbing of all, that US government contractor DynCorp threw a party at which children were prostituted (see also here), meaning that US taxpayers paid for sex with minors.

If the public has access to these revelations, it can better hold public officials to account. If it does not, it is more likely to believe the government line that all is swell over there. As Ron Paul explains, many officials taking aim at the messenger are simply afraid that these revelations threaten their pet project, an American empire.

Furthermore, by extension, Wikileaks’ detractors support the idea that the government can look at your emails, phone and bank records, track your car by GPS and give you a complete body scan, but we, the little people, cannot do the same to the government. If the people’s security increases due to the government’s power to violate your freedom so extensively, and from its spending billions of dollars to do so, why could the intelligence services not prevent 9/11? The billions of dollars for “homeland security” are about scaring you into seeing illusions of security. Now, we are getting a glimpse, however slight, at the wizard behind the screen.

In times of war, governments often declare a state of emergency, meaning, in effect, that citizens are no longer to be trusted with their own freedom. Since World War Two, the United States has experienced a permanent state of war in the form not of a clear and present danger but as creeping threats largely manufactured by the government whose popularity rises as it makes war. This battle could become a Long War, or some kind of war of attrition. Do not be surprised if this conflict requires laws that limit and track your internet use.

An assessment of US drug war policy: no victories, only failure

What is the purpose of law? To promote justice and eliminate injustice, or to promote violence and corruption? US federal drug laws do the latter, domestically and around the world. This post is an assessment of the effects of the War on Drugs on the world. If you cannot stand the sight of blood, look away.

American demand

The criminalisation of drugs began with alcohol prohibition in the US. Dr Hamilton Wright was named a delegate to the US-initiated International Opium Commission of 1909 and soon started pushing for the prohibition of all drugs. To do so, he sought out evidence of enormous numbers of drug addicts in the US, which there were not, and made up figures where the real ones were unconvincing. At the time, narcotics were dealt by doctors. After a few maneuvers around the constitution (that annoying thing again), Wright had the federal government terrorise physicians into compliance with his ideals.

Meanwhile, Wright pronounced liberally on the “drug-crazed Nigger”, fanning the flames of racism with lies we would scoff at today. “Cocaine,” said Dr Wright, “is often the direct incentive to the crime of rape by the Negroes”. Because of the sea of propaganda, a country that in 1900 looked at drug addicts as unfortunate medical cases saw in 1920 a horde of “drug fiends”, twisted, immoral vampires.

The Anti-Saloon League lobbied for 30 years for prohibition. When they finally succeeded, they issued a statement saying that “an era of clean thinking and clean living” had begun. Unfortunately, the reverse was true. Crime rose 24% in US cities in the first year of Prohibition, and the courts were soon overwhelmed. (Sound familiar?) Historian Andrew Sinclair says “National prohibition transferred $2b a year from the hands of brewers, distillers and shareholders to the hands of murderers, crooks and illiterates.” Police killed gangsters, but they could not get them arrested, because witnesses were afraid to testify against them. Because criminalisation did not affect demand, prices did not change and more people entered the black market to replace those who were shot. Moreover, because the restrictions on, say, selling alcohol to minors, were removed, underage boys and girls could get liquor without being carded. The moral and logical arguments for criminalisation of hooch had already fallen on their faces.

After Prohibition ended, the people needed a new enemy, and in the 1930s, the lies began flooding the press about marijuana. For instance, marijuana was said to induce murder (perhaps the best known example being “Reefer Madness“), and children were said to be buying it in droves. The racism had not abated, of course, and charismatic spokespeople without consciences were now accusing Mexicans of bringing in marijuana and driving everyone crazy (though the N-s weren’t spared the groundless accusations either). Legislation got harsher. Jail times rose, police powers expanded and nothing changed on the street.

The War on Drugs is based on lies. If Reefer Madness were not enough, here are two more examples. Take Richard Nixon. When Nixon came into office, his opponents–in short, hippies–were of the cannabis culture, and Nixon’s reputation for petty vindictiveness can be seen in his approach to marijuana. In order to scare everyone, Nixon’s government fabricated numbers. According to their data, the number of drug addicts rose from some 70,000 in 1969 to 500,000 in 1971. Upon completing a survey, the Bureau of Narcotics thought the latter figure was off by about 800%. Second, remember “crack babies”, the 375,000 misshapen, ineducable freaks that were going to populate the US? They turned out to be as real as Negro Cocaine Rape. But they scared people into supporting the drug war, so the idea alone served its purpose. On the other hand, the lies have been counterproductive in other ways. By the 1990s, kids in the US were so used to grown-up scaremongering that they assumed all the tales about how bad heroin was for you were lies too. Next thing you knew, the rate of heroin addiction had jumped 20%, and the number of heroin-related emergencies doubled between 1990 and 1995.

The War on Drugs has been called racist, a claim that could easily be brushed aside if not for evidence. Today in the US, most drug users in all categories are white, yet blacks run a 500 percent greater risk of being arrested for drug offenses. By 1990, black men and women were 10 times more likely than their white counterparts to be referred to the authorities for drug charges.

The War on Drugs brings the US in constant conflict with the constitution meant to contain it. The US Constitution starting eroding long before the Patriot Act. Police seeing black teenagers walking on the street might throw them up against the wall and search their pockets without justification, which breaks the Fourth Amendment against arbitrary search and seizure. Even if they find drugs, the police cannot simply take it to a judge, tell the judge “this kid looked suspicious so I searched him” and expect a conviction. As a result, there are innumerable cases in which police claim that the suspect dropped a suspicious-looking bag on the pavement, which is perjury. (For more on police corruption, see here.)

The figures speak for themselves. The US murder rate peaked at the end of alcohol prohibition, shot up again at the end of the 1960s and has barely moved since then. The US federal drug war budget steadily increased by billions of dollars annually and has shown no results. The national prison population doubled between 1976 and 1986, and nearly quadrupled in the following decade. The numbers have not decreased since then. The facts are unequivocal: prohibition does not work.

Latin supply

What is the US government trying to achieve with its policy of tackling drugs at their source? It seems to be trying to eradicate the supply of drugs, but that is futile while demand is still high. Efforts must then be put into disrupting the supply of illicit drugs, driving up the retail price and reducing demand, right? But after three decades, billions of dollars of effort and many dead drug warriors, prices are down. The 2001 price of heroin is 20% of that of two decades earlier; the price of cocaine barely a third of its former price; and the price of marijuana way off its 1991 peak. Ted Galen Carpenter, vice president for defense and foreign policy studies at the Cato Institute, says “[u]ltimately, the prohibitionist approach is an attempt to repeal the economic law of supply and demand, and therefore it is doomed to fail.” The illegal drug trade, also despite all the effort expended (or perhaps even because of it), has gone global.

In 1969, Nixon commissioned a task force to recommend eradicating Mexico’s drug crops. The Mexican government said no, and Nixon took revenge. He deployed two thousand customs and border patrol agents along the US-Mexico border to conduct an enormous search-and-seizure operation. The desired effect–chaos–was reached.

Jimmy Carter’s presidency softened on drugs, and since then drug warriors have been seething, attempting to establish cause and effect relationships between Jimmy Carter’s supposedly lax drug policies and the rise in drug use during his presidency. Eleven states decriminalised private marijuana use without the federal government breathing down their necks. Nonetheless, during that time, the US government continued to put pressure on Mexico, Colombia, Peru and Bolivia to end drug cultivation, a baton that Ronald Reagan could pick up when he assumed power. Reagan made it clear that the War on Drugs would be a big priority of both his domestic and foreign policy.

Conservatives held up drug use as the reason for the upsurge in crime in the US (though the real culprit was obviously drug law enforcement). Senator Paula Hawkins (R-FL), for example, said drugs were “the single most threatening menace to civilization today.” But despite such alarmist rhetoric and poor sentence structure, drug consumption did not decrease. They decided instead to try to shut off the supply. Representative Charles Rangel (D-NY) blamed the administration for not waging a sufficiently serious War on Drugs. His criticism evinced the increasingly militant attitude of Democrats and Republicans alike toward drug-source countries in the mid-1980s. Drug laws got harsher, including instating the death penalty for major traffickers and life in prison for repeat offenders. Between fiscal years 1980 and 1987, US spending on countering the international narcotics trade tripled. Yet by 1989, the DEA earned more revenue from seizures than from its congressionally-allotted budget.

The government’s National Security Decision Directive (NSDD) on the drug trade said that, not only were drugs corrupting governments, insurgent and terrorist groups were cultivating them to finance their operations. Revelations that the Taliban, NATO’s latest insurgent enemy, have done the same should have come as no surprise to anyone familiar with the drug war. The same directive insisted on an escalation and further militarisation of the drug war. A CBS-New York Times poll of April 1988 found that half of respondents believed drug trafficking was the number one problem in the world. Washington had both the will and the popular mandate to ramp up the War on Drugs. Government spending on drug law enforcement went from $1.2b in 1981 to more than $5.7b in 1989 (the days of Reagan’s small government promises). Ironically, though not surprisingly, both usage rates of and violence connected to drugs rose during the same time.

The implementation of the directive effectively securitised drugs, which means that drugs officially became a threat to national security, and had to be dealt with accordingly. The military was enlisted to help even in domestic drug law enforcement. For instance, one law asked the navy to secure borders against all vessels containing narcotics. Such a suggestion was ludicrous, of course, as even attempting to do so would have destroyed trade and diverted drug smuggling to other routes. A lot of the billions of dollars sent to Latin America went to militaries, which Galen Carpenter calls “an extremely dubious strategy given the long history of military coups throughout the region.”

Much of Reagan and Bush’s efforts had centered on Peru. Peru is a natural haven for coca plants: they grow like grass in the vast jungles and even on the sides of cliffs. American officials encouraged Peruvian farmers to grow rice, tomatoes and beans. But such crops require time and money to cultivate, whereas the coca plant just needs air. Coca plants last forty years and are harvested every ninety days. Farmers in Bolivia planted various crops for cash incentives from the US, but by the end of the season they returned to coca because supply of fruit, nuts and ginger had far outstripped demand. Who needs tomatoes? Moreover, the buyer comes to you and does not bother with taxes, customs or paperwork. Smuggling is so easy because, according to a former assistant secretary of state for international narcotics, “[f]our Boeing 747 cargo planes or thirteen trailer trucks can supply American cocaine consumption for a year.”

As US officials put pressure on their Latin American counterparts, the latter tended to blame the US and suggest that the problem was on the demand side, rather than their side. They saw the US sense of urgency as self-serving, aiming to put Latin Americans in harm’s way to stop Americans from doing drugs. Moreover, many Latin American cultures differed from that of the US in terms of its taboo on the use of narcotics. Peasants in the Andes have been chewing and brewing tea from coca leaves for centuries. Jamaicans and various Latin American countries accept casual marijuana use as part of the culture. Why would they forcibly change their culture for a bunch of self-righteous Yanks?

Many officials were also colluding with drug cartels. Manuel Noriega is the obvious case; but before he was even indicted (and thousands of Panamanians killed), many high-level members of Panama’s government and Panamanian bankers were making money off drugs. The invasion of Panama in December of 1989 was portrayed as an anti-drug effort, to take out Manuel Noriega. Noriega’s friends in the State Department had looked the other way on his drug trafficking, but by 1989, because of the administration’s anti-drug rhetoric and the mounting evidence against Noriega, doing so had become politically untenable.

Ronald Reagan and the law-and-order promises he made were no better than Nixon, imposing yet stronger drug laws, killing and arresting people all over the place and taking the War on Drugs worldwide. George H.W. Bush had been Reagan’s point man for the anti-drug campaign, and after eight years of nothing to show for it, he told the American people, “Take my word, this scourge will stop.” Yet, how did Bush have the power or even the moral authority to stop it? Bush’s government had known for some time about contra drug smuggling and Noriega.

In November of 1989, the US Justice Department issued the alarming legal opinion that the US military had the authority to pursue and arrest drug traffickers overseas, even without the host government’s consent. Soon after its invasion of Panama, which the Bush administration touted as a victory over the drug scourge, the US stationed a fleet of aircraft carriers off the coast of Colombia, without the Colombian government’s permission, in order to apprehend Pablo Escobar.

Pablo Escobar is perhaps the most notorious of the billionaire kingpins who have made their fortune from drugs. Violence in Colombia exploded as Escobar mounted a campaign of horrific terrorist violence to avoid extradition to the US. After a huge effort, Escobar was shot dead, and the flow of drugs did not change. He left behind a Colombia of crooked public officials and fearful citizens.

Where the US government considered the host government’s permission important (Article 173 of Colombia’s constitution states that foreign troops are not allowed to operate on Colombian soil), it applied pressure to obtain it. It became easy for left-wing guerrillas like the Sendero Luminoso to paint governments as American puppets. The FARC and ELN started because Colombian peasants were angered by their government. These are people whose legitimate trades were driven bankrupt by US taxpayer-subsidised agribusiness. Ted Galen Carpenter suggests that, given that the FARC and ELN do not have wide support, their base might have dried up if not for the violence and crop destruction of the War on Drugs. In spite of concerted crop spraying, coca continues to flourish in Colombia, just as it did in Peru in the 1980s. What have been the effects of spraying crops? Toxins emptying into the Amazon basin and increased cancer rates among the farmers. (Learn more here.)

Gustavo de Greiff, Colombia’s prosecutor general in the 1990s, was not afraid of US pressure. The War on Drugs

does not have victories, only failure. Despite spraying and manual eradication, the areas of cultivation have not diminished, only increased. Drug interdiction doesn’t even reach 10 percent of the drugs that reach international markets. We kill the big capos, we put them in jail, we extradite them to the US–and yet prices don’t even move…. We have to study legalisation…. Change frightens people. There are a lot of vested interests in the drug war. There are a lot of people who would lose their jobs with legalisation…. Legalisation is the worst thing that could happen to drug traffickers.

But Ernesto Samper, Colombia’s president at the time, was eager to continue to placate the Clinton administration and not budge on drugs. Outrage at his crop fumigation policies spilled into the streets when 50,000 peasants protested.

Samper was one of countless Colombian politicians who may have attained power partly through drug money. DEA agents in Mexico, Colombia, Peru and Bolivia witnessed a large percentage of police and military personnel making money off the drug trade, either by turning a blind eye or even directly aiding it. Prohibition and pressure were making some groups rich. As Americans pressured Latin American leaders to clamp down on drugs, those who did often ended up threatened by the now very powerful cartels.

Despite all efforts to eliminate the drug traffickers themselves, they tend to follow the “push down, pop up” effect: attack them in one place and they will leave for another. Eradication efforts have been useless for the same reason, as any success in destroying crops has simply pushed them to another part of the vast hinterland of the Andes. Interdiction of drugs en route, once again, does nothing, because as the authorities push down on one spot, say on what they believe is the traffickers’ current favourite spot on the US-Mexico border, the next traffickers move somewhere else.

The War on Drugs fills the cold void

The collapse of the Soviet Union and the slipping away of an enemy meant certain US government bureaus, such as State and Defense, would face major reductions in budgets. They needed a new enemy, and a new war. They had the creeping War on Drugs, and seized upon it. Bush’s Secretary of Defense, one Dick Cheney, was one of the high ups who seized on the NSDD’s securitisation of drug trafficking and set about reordering his department to tackle it. During the latter stages of the Cold War, the US’s strategy had been to engage in small wars that were easier to win to contain communism. As the threat from communism receded, the War on Drugs filled the void.

The public generally swallowed the tripe about drugs’ being the US’s biggest threat, and the need for increased military spending to stop it. Drug cartels were seen as evil in the same way as communists had been (and terrorists are today). The ideological elements of the Cold War provided a pretext for US military intervention anywhere there was a perceived communist threat. The equivalent today is, of course, the War on Terror. Also like the other two wars, drug warmongers framed their war as one that could last generations. Between the Cold War and War on Terror, the War on Drugs fit like a glove. It was the ideal justification for intervention.

Huge amounts of aid were handed out to the governments of Colombia, Bolivia and Peru for signing on to the Andean Initiative and pledging to reduce drug traffic. Of course, US government drug war plans did not stretch very far into crop substitution (to the objection of governments on the ground that knew better) or other options beside violence. Since governments obtain their resources by force (taxation), it is natural that they might have a blind spot regarding alternatives to it.

Under Bill Clinton, the War on Drugs led to more Americans in jail on drug offenses, more military assistance to Latin American governments and more military interdiction on the US-Mexico border. Clinton demanded that assistance to Colombia be spent fighting narcotrafficking, as this was the US government’s big concern. However, Colombia has two major anti-government guerrilla groups, the FARC and the ELN, and they are partly financed by the drug trade. (The other part is kidnapping.) These groups frequently work with whichever narcotraffickers are in the region they control. Supplying the Colombian military with hardware and telling it not to use it against groups it is at war with is futile. And after 9/11 of course, the distinction between narcotraffickers and “narcoterrorists” was erased.

Millions of Colombians have been displaced by the fighting, and middle and upper class Colombians have left Colombia in droves. A reporter described lines that “snake around the block near foreign consulates where people stand in line all night seeking visas.” Colombia has received $5b in aid since 2000. The “left-wing” FARC guerrillas have grown weaker but the military-linked paramilitaries have not. 35,000 civilians died during the 1990s, and though 2.5m Colombians have been forced from their homes in the past decade, only a couple of thousand have been killed. As anyone with a newspaper can tell us, the killing has moved to Mexico. Even before the recent escalation under Felipe Calderon, Mexico had had its share of rich drug barons, corrupt policemen and dead victims in the crossfire. Galen Carpenter explains the conservative attitude in Washington to bad policy. “The attitude of US officials about the progress of the international phase of the drug war has a dreary consistency. Setbacks are ignored or explained away; every sign of success is touted, often to the point of absurdity; and victory is said to be just around the corner–if the current policies continue awhile longer.” What Richard Cowan calls the iron law of prohibition is that, “the more intense the law enforcement, the more potent the drugs will become.” Marijuana has become more potent (and crack was invented) because traffickers want to reduce the bulk of their cargo. The situation was no different during alcohol prohibition, when bootleggers developed white lightning, the 190-proof crack of the 1920s. Even worse, industrial alcohol, of the sort used to make paint and plastic, was usually added to what was drunk. One can only imagine what today’s street drugs have in them.

The solution

At present, illegal drugs are taxed. However, instead of democratic governments collecting the tax, it is the drug traffickers who collect it. Gustavo de Greiff explains. “As long as the trade is illicit, the narcotraficantes will continue to receive these immense profits that allow them to corrupt everyone…. In 10, 15, 20 years, we will finally arrive at controlled legalization,” he predicts. “What makes me sad is that when this measure is finally adopted we will look back at all the deaths, all the corruption, and everything evil that drug trafficking brought us in the intervening 20 years.”

All kinds of people support legalisation: police, doctors, and if they are not convincing enough, celebrities. Former Uruguayan President Jorge Batlle said “During the past 30 years [the War on Drugs] has grown, grown, grown, every day more problems, every day more violence, every day more militarisation. This has not gotten people off drugs. And what’s more, if you remove the economic incentive…it loses strength, it loses size, it loses people who participate.” The presidents of both Mexico and Colombia–the countries hardest hit by the consequences of drug criminalisation–have called at least for debate on the issue. Some Americans are listening, hence the California legislature’s recent decriminalisation of marijuana. If more Americans begin to realise the trouble their government’s policies are causing, they will vote to change them. The legalisation of drugs will not make them disappear, as the millions of people hooked on prescription drugs attest to.

Britain and the Netherlands both experimented with decriminalisation. Like in the US in the 1920s, British physicians were allowed to prescribe heroin and the government could do nothing about it. What were the results? When Dr John Marks made a survey of Liverpool in 1982, he expected to find AIDS rates of 15 to 20% among heroin users. Instead, he did not find a single case. Another surprise came from local police in Cheshire, who had tracked 100 users and found that after entering clinics, their tendency to crime fell by 94%. Fewer overdoses were reported, and fewer people were trying heroin. One would be correct to guess that all the same harm reduction was reported from the Netherlands. Portugal has had even more success. Can we learn nothing from them?

Winston Churchill once said that “without victory, there is no survival.” A century of failure with one obvious source can be reversed, and victory attained, but not before the end of the War on Drugs.

Karzai’s Compromises

Hamid Karzai is quite the shrewd politician. He realises that his foreign friends with the big guns could be leaving Afghanistan soon, and is expending considerable effort to ensure that he remains in power after they leave.

Renewed efforts to shore up local Afghani defense forces are meeting with the approval of Karzai and General David Petraeus, who knows as well as Karzai that the US and its allies are on the way out. Former UK Prime Minister Gordon Brown, in a hilarious political euphemism, once called the groups they are trying to form “community defense initiatives“. Such local forces are, in effect, militias or paramilitary units that are supposed to fight the Taliban or keep it at bay (or, to the truly deluded, dismantle and destroy it). But there are a couple of reasons why that might not happen.

First, it is unlikely that these local forces feel much loyalty to Hamid Karzai or his government, which is seen by many Afghans as a puppet of foreign occupiers. Even if Karzai were seen as legitimate, ordinary Afghans are not likely to respect a government that forces them to pay large portions of their income in bribes for public services. They may even join the other side. There is no reason to think they would be less loyal to the Taliban than anyone else who might pay their salaries. These bands of fighters will not protect Afghanistan but only their friends and family. If there is a more effective route to doing so, for instance getting paid better by income from poppy farming, which might come from anyone, they could take it.

Second, Karzai is making deals with the Taliban, too. The consummate pragmatist, Hamid Karzai realises that the Taliban is strong, stronger than he, and without thousands of ISAF troops behind him, his future is uncertain. The US government has blacklisted many Taliban leaders by name, which means placing them on a UN list presumably so that they are not allowed to fly or talk to officials anywhere the US or UN have enough influence to stop them. Hamid Karzai asked the UN to remove as many as 50 of the names from the blacklist so that he could talk to them. Besides the fact that they are not all terrorists (whatever American authorities say), Karzai is reaching out to those who will want to wrench power from him when he is weak.

Hillary will visit Kabul soon for an international conference on Afghanistan after her present trip to Islamabad. (Her visit and its urgency were heralded by a suicide bombing in Kabul yesterday, not far from the US embassy.) She will likely discuss the US’s plans for reintegrating low level Taliban, the militias, anti-corruption efforts and aid, all of which are meaningless if there is no strong commitment to them for the next ten or twenty years. But we do not have ten or twenty years. The Barack administration plans to begin, carefully, to withdraw troops from Afghanistan in 2011, a year before an election. 2011 and 12 could be interesting years for the short term future of Afghanistan; however, its medium and long terms are in the hands of Afghanis. A British withdrawal is scheduled for 2014; however, if British forces suffer inordinate casualties due to increased pressure from Afghan fighters, the curtain may fall before then. Karzai will attempt to make it look as if he was the strong leader who demanded that the foreign troops leave. The real reason ISAF troops are leaving, however, is because the citizens they answer to are no longer convinced it is in their interest to shore up another corrupt dictator of a failed state.

If all these deals and olive branches and community defense initiatives work, it could mean that the US government claim that Afghanistan will fall apart if it leaves might turn out false. Again, Karzai is a shrewd politician, which means he is a power broker, and his remaining in power for now might mean an end to the decades of conflict Afghanis have had to endure. Either way, Karzai’s actions are a clear indication that relying on the ISAF to always be there would be foolish.
